| What is
the Employment Tribunal Process?
After a claim is filed, the Respondent has 28 days to file a defence. When
the defence is received the Tribunal will then list the directions which
are the steps that must be undertaken by both parties in the run up to the
hearing date. The number of days the final hearing is listed for will depend
upon the complexity of the case and the number of witnesses that are likely
to be involved.
The Tribunals can usually judge by the detail in the claim form and defence
forms as to how many days the hearing should be listed for but either party
is able to make representations to the Tribunal and ask that the length
of the hearing is shortened or extended accordingly.
